In COURT ON ITS OWN MOTION vs STATE, the Delhi High Court has ruled that the rejection or acceptance of anticipatory bail of an accused by the High Court is not relevant for consideration of the regular bail of the accused under Section 437(1) of the Code of Criminal Procedure, 1973.
However the court also clarified that in this case it is dealing with a specific fact situation, namely, where the accused in respect of a cognizable non- bailable offence is not arrested during investigation by the police, and the charge sheet is filed before the Magistrate without such arrest/ detention and the
discussion is relevant to this situation.
